How Is Child Support Determined?


While the first concern of most parents is the well-being of their children, they are also often rightfully concerned about the amount of money that may be required for child support payments. In California, child support guidelines utilize a complex formula to determine how much child support must be paid. This formula takes a wide range of factors into account.

The Main Factors That Impact Child Support Payments

One of the most influential factors in determining child support is the actual income of each parent, as well as the percentage of total income that each parent brings to the table. From there, the court will consider how much time each parent will be spending with the children. Generally, the more time a parent spends with the child, the less child support they will be required to pay.

The State Will Consider Expenses

The costs associated with raising a child, including child care, healthcare, or other unusual expenses will all be taken into account when determining child support. The state may also take into consideration any additional support or alimony payments that a parent may be currently responsible for, and can deduct them from that parent’s income. Additionally, the court will deduct taxes, mandatory fees like union dues, health premiums, and other potential expenses.
