The Dangers of Social Media During Divorce

Person using social media during divorceNo matter where you look, pretty much everyone is on social media in some form or another. Most people have trouble even putting down their smartphones when they are not occupied with a more pressing task. While social media apps like Facebook, Twitter, and Instagram are great ways to find entertainment and connect with others most of the time, they can be downright trouble if you are in the middle of a divorce.

While divorcing, you can find yourself going head-to-head with your soon-to-be ex-spouse over any number of topics and concerns, especially if your divorce will be contested. You need to settle child custody, alimony, property division, and much more so your divorce can finalize. Ideally, things will conclude in a way that upholds your best interests. To work in their own favor, your spouse will undoubtedly look for any “evidence” to use against you and your arguments. This is where social media becomes problematic.

What Not to Post on Social Media During a Divorce

Once-innocuous posts can be twisted and misconstrued by your ex-spouse to look worse than they are. For example, imagine a divorce that includes a contest over child custody. You really want to be the parent who gets sole or primary child custody. To relieve some stress from the pending divorce, you give yourself one night to see your friends and have fun. Someone posts a picture of you drinking a shot of alcohol, which was your only drink of the night. Your spouse sees the picture on your social media accounts, saves it, and brings it to court, arguing that you are too much of a “party animal” to take care of your children. As ridiculous as it seems to you, the court might be swayed unless it is given strong counter-evidence.

The easiest way to make certain none of our social media posts are misconstrued during your divorce is to not make any posts at all. Avoid using social media however you can. Some people even tell their friends to change their password until the divorce is over. Just do not rush to make your account private, as this might look suspicious and ultimately work against you.
